USCG Announces Ballast Water Management (BWM) Compliance Program Update

On December 2, 2016, the United States Coast Guard (USCG) issued its first Ballast Water Management System (BWMS) type-approval certificate, ushering in a new era in environmental compliance for companies operating commercial vessels with ballast water systems in U.S. waters (within 12 nautical miles). Based on public information about other, pending applications, we expect additional type approvals to issue soon.

According to the USCG, with type-approved BWMS now available, any owner/operator of a commercial vessel requesting a BWMS extension to the regulatory deadlines for compliance must provide the U.S. Coast Guard with an explicit statement supported by documentary evidence that installation of the type approved system is not possible. Previously, since no BWMS had received USCG type-approval, vessel owners/operators could apply for extensions to a vessel’s compliance date by annotating that compliance was not possible.

IMO Convention on Ballast Water Management Ratified - What's Next?

Last week in Law at the Waterline, we celebrated the ratification of the IMO convention on ballast water management, an event we described as “a major milestone for enhanced protection of our oceans and a profound business driver for marine-environmental technology.”  As we progress to towards the convention’s permanent implementation date of September 8, 2017, Law at the Waterline will have a series of posts tracking this process and progress of implementation, including type approval and other standards for treatment technologies and developments expected in the U.S. Coast Guard’s promulgation of its requirements. We begin the series this week with some background information in a post by Grace Denny, a student at Boston College.

Ecochlor Completes All Land-Based and Shipboard Testing for USCG Type Approval

May 2, 2016 - Ecochlor, Inc. is pleased to announce the completion of all land-based and shipboard testing at the Golden Bear Facility (GBF) in preparation for submission of the application for USCG Type Approval. The system was verified in all three salinities, 5 test cycles each, for a total of 15 consecutive and successful cycles to meet the USCG requirements.

IMO Ballast Water Convention May Not Need More Ratifications to Go Into Effect

To become binding on the world’s merchant fleet, the IMO standards for ballast water management must be ratified by countries that constitute 35% of the world’s shipping tonnage. This has been on the verge of occurring for some time. When last updated by the IMO, the percentage was over 34%. IMO usually updates the tonnage percentage yearly, but has switched to updating its flag state fleets database monthly. An article in Ballast Water Treatment Technology posits that as a result, it is possible that normal daily variations in flag state tonnages could mean that the 35 per cent threshold has been transcended.
